1. What to do if your flight is DELAYED?

Your flight is going to be late. What does it mean?

Could you be entitled to compensation for delay?

1.1 If you are still at home

Call the airline to learn more about the check in status.

If check in is going to be delayed, wait for a while.

Even if you have already checked in online.

If check in isn't delayed, go to the airport as normally.

Do you have another flight you may miss?

What kind of flight is it? There are two most likely scenarios — good and not so good. If it’s an airline-protected connecting flight, then it’s good. Then you are protected. If it’s a flight you have booked separately, then it’s not so good. Because then it’s your responsibility if you miss that connecting flight. Flights like these are called self transfer flights.

1.2 If you are already at the airport

Then as well — find out what’s happening with check in.

If check in hasn’t started, for now just wait.

Don’t go anywhere. Don’t do anything. Just wait.

If check has started, that’s a good sign.

Check in for your flight and proceed as normally.

Most likely it’s gonna be a short flight delay.

Clock on the wall

- 3 hour flight delay

LATAM is not a European airline.

Despite that, on many of their flights you are protected by the EU. Most of people don’t know that. They don’t know European laws. They don’t know that they have a right to care from the airline. If it’s a delay of at least 3 hours, LATAM has to offer you a free meal and drink.

This applies to all LATAM passengers.

All thanks to Regulation EC 261/2004.

- Long delay (Overnight delay)

If the delay is longer, you may also get a hotel room.

The airline has to offer you free hotel room and free transfer.

Everyone has the right to this type of care.

As long as the flight departs from the EU.

1.3 If it is fault of LATAM

That includes things like technical problems and staff shortage.

In this case, you may also be entitled to EU flight delay compensation.

Have you experienced a flight delay?

If you have — file a compensation claim.

2. What to do if your flight is CANCELLED?

Your flight has been cancelled. What does it mean?

Will LATAM offer you a new flight? Will you have to pay for it? In what situations can you ask for compensation from LATAM? If the flight is from the EU, you can get everything — both compensation and also a new flight completely for free. We’ll go into details below.

2.1 If you are still at home

You need to find out what’s happening next.

Contact LATAM, if they haven’t yet contacted you.

If it’s a flight departing from the EU, you should be given a choice between a new flight and a full refund. Even if it’s a flight cancellation due to extraordinary circumstances. If it’s a flight departing from somewhere else, then it’s different. Then it depends from their policies and type of your ticket. In any case, contact the airline to find out what’s happening next.

If it’s fault of the airline, you may have a right to compensation.

More on that further below.

2.2 If you are already at the airport

If your flight is cancelled, don’t go anywhere.

Don’t proceed through the security checkpoint.

If a flight is cancelled, your boarding pass isn’t valid anymore. And if there will be a new flight, you’ll have to check in for that new flight. This is how it works. So, don’t go through the airport security. First try to get in touch with the representatives of LATAM.

A red alarm clock

- 3 hour flight delay

LATAM is a South American airline.

Despite that, on many of their flights you are protected by the EU.

If a flight departs from the EU, and you have to wait for 3 or more hours extra, the airline has to provide you with two free phone calls or e-mails and also a free meal and drink.

All thanks to Regulation EC 261/2004.

- Long delay (Overnight delay)

Will you have to wait overnight? Is it a flight that was about to depart from the EU? If you answered yes to both questions, then you have a right to free accommodation.

LATAM has to take care of that.

2.3 If it is fault of LATAM

That includes things like technical problems and bad planning.

If that causes a cancellation, it is considered fault of the airline.

And you may also be entitled to EU flight cancellation compensation.
