UK / EU air passenger rights

Air passenger rights are almost identical in the EU, EEA and UK.

That's why we may refer to them simply as European air passenger rights, and use terms like European flight compensation and European flight compensation regulation. We may also use a word "Europe" to refer to this whole region, where the flight compensation regulations EC 261/2004 and UK261 are in effect.

  • With European airlines these rules apply to all flights to and from Europe
  • With non-European airlines - flights departing from Europe

- How long does it take?

Compensation claims take around 3 months.

Sometimes less, sometimes more, depending on the airline’s responsibility and some other factors. In summer it generally takes longer, because there are more flight problems and more people are making compensation claims. It will take longer, if the case will have to be taken to court.

- How far back can you claim flight delay compensation?

The answer will depend on one main factor — country.

You have to look at the laws of the country your flight was from. Generally speaking, in Europe the answer mostly is either 2 or 3 years. Meaning you can make a claim for flights that are already up to 3 years old. Register the flight with us and we will do the investigation.

You can get compensation also for flights that happened in the past.

- Does it apply only to citizens of the European Union?

Absolutely no, it applies to every single passenger.

You have a ticket? You have the same rights like the rest of the passengers on this particular flight. If others are entitled to EU/UK flight compensation, you will be too. You don't have to be European to have these rights.

- How much can you claim?

The longer the flight, the more you can claim for delay.

Mostly the amounts are between 250 to 600 euro per passenger.

These amounts are the same for all passengers travelling on the same flight. No matter the nationality, airline you are flying with, price of the ticket or travel insurance. In the EU and UK, even infants can receive full flight compensation.

2. TAROM compensation: How to claim TAROM flight cancellation compensation?

There are two conditions that should be met.

Conditions:

  • It must be fault of TAROM
  • It must be a last-minute flight cancellation

If a flight is cancelled not more than 14 days before the planned date of departure, then in Europe it’s considered a last-minute cancellation, and you have a right to UK/EU flight cancellation compensation. There are two options how to claim TAROM compensation for cancellation.

1. You can do it all on your own.

In a way very simple, but likely time-consuming — you do everything.

You do all the negotiations. You prepare all the necessary documents, whatever the airline asks. You do your own investigation, if there’s a need for some extra information or proof. To start the process, you have to contact TAROM (either online or by calling the airline).

2. You can hand the case over to us.

More simple, more effective and 100% stress-free.

Everything is done on your behalf. Legally this process is called legal representation. In this case, it’s us — a flight compensation company — who do all the negotiations and prepare all the necessary paperwork for negotiations and court. Everything that’s necessary is done on your behalf, including paperwork preparation for court proceedings.

- How long does it take?

1, 2, 3 months, if the process goes smoothly.

4, 5, 6 months, if it’s necessary to take flight compensation case to court. That’s our estimate from our experience working with these claims since 2018. The more people and institutions involved, the longer it takes. If you do it with us, we will update you on the progress.

- How far back can you claim flight cancellation compensation?

It depends from the country, but mostly — up to 3 years.

It isn’t regulated centrally, so the number varies from country to country. Mostly, in Europe, you can get compensation for flights that were heavily delayed or cancelled up to 3 years in the past. Here’s a simple step that makes things easier — register the flight as soon as possible. Don’t wait.

- Does it apply only to citizens of the European Union?

No, these laws — both EU and UK — protect everyone.

Your nationality doesn’t matter. If the flight falls under the flight compensation regulation, and the airline has to pay compensation for cancellation, all passengers will be entitled to it. You don't have to be European citizen to have these rights and to receive European flight cancellation compensation from airline.

- How much can you claim?

The amounts are regulated by the above mentioned regulations.

Here is how much you can claim for your flight:

  • €250 — if the distance of your flight is up to 1500 kilometres;
  • €400 — if the distance is between 1500 to 3500 kilometres;
  • €600 — if the distance is more than 3500 kilometres.

These amounts are per passenger.

They are the same for all passengers.

3. How to claim TAROM denied boarding compensation?

You may get denied boarding even if you have a valid ticket.

It may happen if the airline has sold too many tickets. Whenever you are denied boarding against your will, you have a right to EU denied boarding compensation.

With TAROM it applies to all their flights to and from Europe.

Compensation amounts are fixed — 250, 400 or 600 euro.

In these situations, mostly you can get both:

  • new flight to destination or refund
  • denied boarding compensation

It applies only to overbooking. If there are problems with your travel documents or visa, or your passport expires soon, you can’t get denied boarding compensation. You also won’t be entitled to denied boarding compensation if you voluntarily give up your seat, and agree to fly later.

3.1 Why does overbooking happen?

Because sometimes airlines sell too many tickets (hoping that someone won’t come).

When an airline has sold too many tickets and everyone arrives, you may be asked to give up your seat due to overbooking, and fly later (same day or another day). You can accept the airline's offer of a replacement flight or decline it; the choice is yours!

3.2 Voluntary vs involuntary denied boarding

What’s the difference between voluntary and involuntary denied boarding?

There are situations when you aren’t given any choice. If you are not allowed to board a plane even though you have met all of the travel requirements, this is called "involuntary denied boarding". You should get European denied boarding compensation from the airline if it was not your fault. This is part of European regulations.

You may also decide to volunteer and fly later. Sometimes it just makes sense to volunteer. If you are ever asked to give up your seat on a flight, you may decide to take an advantage of it. You see, gate agents often offer passengers discounts codes, vouchers and airline travel credits as well as complimentary hotel stays in exchange for their cooperation.

The latter is called "voluntary denied boarding" (if you decide to volunteer). In this case, you won’t be entitled to denied boarding compensation from TAROM.

4. What to do if your flight is DELAYED?

Your flight is delayed. What should you do?

Sometimes flights get delayed. This can be annoying. But there are things you can do to make it better. This section will help you learn how to manage flight delays quickly so your trip won't be ruined for too long. In Europe you have a right to some nice benefits.

4.1 If you are still at home

Are you still at home or hotel?

If check in is going to be delayed, wait for a while.

If check in isn't delayed, go to the airport as normally.

Do you have another flight you may miss?

There are two most likely scenarios. If it’s an airline-protected connecting flight, you are protected. The airline will take care of you. If necessary you will be put on another flight completely for free. If it’s a separately booked flight, this is your responsibility. Flights like the latter are called self-transfer flights.

4.2 If you are already at the airport

You have already arrived to the airport.

If check in hasn’t started, for now just wait.

Why? Because your flight may get cancelled last-minute. If it happens, your flight ticket won’t be valid anymore, and you will have to get a new one. So, don’t rush.

If check in has started, that’s a good sign.

That’s a very good sign. Most likely it won’t be a very bad delay.

- 3 hour flight delay

TAROM is a European airline.

And that means you are protected by the EU.

Accordingly you may have a right to care. If it’s a long delay at the airport, you may have a right to care from the airline. If you have to wait 3 or more hours extra, TAROM has to offer you with two free phone calls or e-mails (or internet access) and also a free meal and drink.

This applies to all TAROM flights to and from Europe.

All thanks to Regulation EC 261/2004.

- Long delay (Overnight delay)

If the delay is longer, you may also get a hotel room.

TAROM has to offer you free hotel room and free transfer.

Everyone has the right to this type of care.

4.3 If it is the fault of TAROM

It includes things like technical problems and staff shortage.

You may also be entitled to EU flight delay compensation.

Have you experienced a flight delay?

If you have — file a compensation claim.

5. What to do if your flight is CANCELLED?

Your flight is cancelled. What should you do?

Will they give you a new flight? Today or tomorrow? Is it going to be a free replacement flight? In what type of situations can you ask for flight compensation from TAROM?

5.1 If you are still at home

You need to find out what’s happening next.

Contact TAROM, if they haven’t yet contacted you.

Generally, in the EU and with EU airlines all these things are very simple. If there is a problem, an airline offers you a new flight or full refund, and you choose one of the options. You have a right to ask a full refund if you don’t want to go on the flight offered by TAROM (for example, if it doesn’t fit your travel plans, or you have changed your mind now).

If it’s fault of the airline, you may have a right to compensation.

Scroll back to learn more about compensation.

5.2 If you are already at the airport

Don’t go through the airport security.

This is important. Because you have to get a new boarding pass first. You have to wait for TAROM to offer you a new flight to your destination, and you have to check in for that flight. So, don’t go through the airport security before you have gotten a new boarding pass.

First, contact TAROM to learn what’s happening next.

Ask for a refund, if you don’t want to take the new flight.

- 3 hour flight delay

TAROM is an airline registered in the EU.

And that means you are protected by the EU.

The same rules apply both to delays and cancellations, and to overbooking too. If you now have to wait more than planned, often you have a right to care from the airline you are flying with. The airline has to provide you with some means of communication for free (it can be internet access) and also a free meal and drink.

Cancellations due to extraordinary circumstances?

This applies to all flight cancellations of TAROM.

All thanks to European flight compensation regulations.

- Long delay (Overnight delay)

In this case, you have a right to free accommodation.

Here’s what else you should consider. Yes, passengers have the right to get free help from the airline, like a place to stay if the wait is over night. But the airline will look at each case individually and decide if they should give help or not. For example, if a flight is delayed by 6 hours and it would take another 2-3 hours for people to get to a hotel, then usually no help will be given.

5.3 If it is the fault of TAROM

That includes things like technical problems and bad planning.

If that causes a cancellation, it is considered fault of the airline.

And you may also be entitled to EU flight cancellation compensation.

Have you experienced a flight cancellation?

If you have — file a compensation claim.

5.4 Why do flights get cancelled?

Here are some of the top reasons why flights get cancelled.

By Europe and EU we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin, the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.

Remember, whenever your TAROM flight is delayed, cancelled or you have been denied boarding — you might be entitled to flight compensation. File a claim to get it sorted out right away!
