UK / EU air passenger rights

Air passenger rights are almost identical in the EU, EEA and UK.

That's why we may refer to them simply as European air passenger rights, and use terms like European flight compensation and European flight compensation regulation. We may also use a word "Europe" to refer to this whole region, where the flight compensation regulations EC 261/2004 and UK261 are in effect.

  • With European airlines these rules apply to all flights to and from Europe
  • With non-European airlines - flights departing from Europe

- How long does it take?

With Volotea, it will take around 2 to 3 months.

That is from the moment of starting a process until you receive compensation in your bank account, or at least an approval that the compensation is coming. If it is necessary to take a claim to court, it will take longer than that. Court proceedings for flight compensation claims take at least a month or two, depending on where you go to court (in what country).

- How far back can you claim flight delay compensation?

In Europe, you can claim also for old flight delays.

To give you an exact answer we would need to know from where was your flight. In most countries in Europe it is either 2 or 3 years after the incident. But don’t be put off if the flight is older than that, because in some cases it is possible to get compensation also for flights that are older than 3 years — file a claim with us and we’ll do the investigation for free.

In short, yes, you can get compensation also for old flights.

- Does it apply only to citizens of the European Union?

No, it applies to every passenger on the same flight.

For this it doesn’t matter what country are you from. You don't have to be European to have these rights.

- How much can you claim?

The longer the flight, the more you can claim for delay.

Mostly the amounts are between 250 to 600 euro per passenger.

These amounts are the same for all passengers travelling on the same flight. No matter the nationality, airline you are flying with, price of the ticket or travel insurance. In the EU and UK, even infants can receive full flight compensation.

  • It must be a last-minute flight cancellation

- How long does it take?

With Volotea, it takes around 2 to 3 months.

A thing you should be aware of is that working with low-cost airlines usually is a bit more difficult. They don’t really want to pay the compensation, even when it’s due. They often offer flight coupons instead of compensation first, so you may have to be pushy to get the money. If nothing else works and the case has to be taken to court, it will add another 2-3 months to the process.

- How far back can you claim flight cancellation compensation?

You can get money also for old flights.

In most countries in Europe, you can file a claim up to 2-3 years after the day of cancellation. If your flight was cancelled on January 1, 2023, it is best if you made a claim until January 1, 2025. Because there are countries where 2 years is the maximum period.

But you shouldn’t be put off by the 2-3 year period. As there are also countries where you can get compensation also for older flights, flights that have been cancelled 4, 5 or 6 years ago.

- Does it apply only to citizens of the European Union?

All of this what we are talking about apply to everyone.

These rules are the same for all passengers, from all countries and of all nationalities. When it comes to flight delays, last-minute flight cancellations and boarding denials due to overbooking, you don't have to be European to have these rights and to receive UK/EU flight compensation.

- How much can you claim?

The amounts are regulated by the above mentioned regulations.

Here is how much you can claim for your flight:

  • €250 — if the distance of your flight is up to 1500 kilometres;
  • €400 — if the distance is between 1500 to 3500 kilometres;
  • €600 — if the distance is more than 3500 kilometres.

These amounts are per passenger.

They are the same for all passengers.

3. How to claim Volotea denied boarding compensation?

You may get denied boarding even if you have a valid ticket.

It may happen if the airline has sold too many tickets. Whenever you are denied boarding against your will, you have a right to EU denied boarding compensation.

With Volotea it applies to all their flights to and from Europe.

Compensation amounts are fixed — 250, 400 or 600 euro.

In these situations, mostly you can get both:

  • new flight to destination or refund
  • denied boarding compensation

It applies only to overbooking. If there are problems with your travel documents or visa, or your passport expires soon, you can’t get denied boarding compensation. You also won’t be entitled to denied boarding compensation if you voluntarily give up your seat, and agree to fly later.

3.1 Why does overbooking happen?

In short — overbooking happens because this is how airlines make money.

Overbooking happens because airlines want to offset the costs of no-shows and last-minute cancellations, and maximize profits by filling as many seats as possible. Because every time there are people who cancel a flight at the very last minute, or don’t show up at all.

3.2 Voluntary vs involuntary denied boarding

What’s the difference between voluntary and involuntary denied boarding?

There are situations when you aren’t given any choice. This is called "involuntary denied boarding". When you are simply denied boarding, even though everything is in order with your travel documents, and you aren’t being drunk, rude or anything like that. In this case, you have a right to European denied boarding compensation.

You may also decide to volunteer and fly later.

You may also decide to volunteer and give up a seat.

Why? Because you want that 300 euro voucher that the airline is offering in exchange. And they are also giving you a new flight only 2 hours later, which works for you just fine. This is just one of the possible scenarios. This is called "voluntary denied boarding" (if you decide to volunteer). In this case, you won’t be entitled to denied boarding compensation from Volotea.

4. What to do if your flight is DELAYED?

Your flight is delayed. What should you do?

When air travel is interrupted by delays, it can be incredibly distressing. Fortunately, there are some steps you can take to reduce the inconvenience and make the best of an unfortunate situation. We'll provide several tips on how to handle flight delays efficiently so that you can get back on track as soon as possible!

4.1 If you are still at home

Are you still at home or hotel?

If check in is going to be delayed, wait for a while.

If check in isn't delayed, go to the airport as normally.

Do you have another flight you may miss?

Most likely what you have are self-transfer flights. This is when you book several separate flights. In this case, as the name suggests, this is your self-created transfer. If you miss a connection because of the delay of a previous flight, it is your problem to solve.

With airline-protected connecting flight, it is easier. Then you are protected. Then the airline takes care of you. If necessary you are put on another flight completely for free.

With self transfer you are in charge of all this.

4.2 If you are already at the airport

You have already arrived at the airport.

If check in hasn’t started, for now just wait.

Wait until the check in desk is opened and check in starts.

If check in has started, that’s a good sign.

You can check in and proceed to your gate.

- 3 hour flight delay

Volotea is a European airline.

And that means you are protected by the EU.

If you have to spend more time at the airport than planned, you may have a right to care from Volotea. If you have to wait 3 or more hours extra, the airline has to provide you with two free phone calls or e-mails (or internet access) and also a free meal and drink.

This applies to all Volotea flights to and from Europe.

All thanks to Regulation EC 261/2004.

- Long delay (Overnight delay)

If the delay is longer, you may also get a hotel room.

Volotea has to offer you free hotel room and free transfer.

Everyone has the right to this type of care.

4.3 If it is the fault of Volotea

It includes things like technical problems and staff shortage.

You may also be entitled to EU flight delay compensation.

Have you experienced a flight delay?

If you have — file a compensation claim.

5. What to do if your flight is CANCELLED?

Your flight is cancelled. What should you do?

Do you qualify for a new flight if yours is cancelled? Are there any associated fees to this alternative arrangement? What scenarios entitle customers to reimbursement from Volotea?

5.1 If you are still at home

You need to find out what’s happening next.

Contact Volotea, if they haven’t yet contacted you.

Be prepared to make a choice. Mostly, they will offer you a new flight to destination or full refund. In case of the refund, you can request that to be paid to your bank account. You don’t have to agree to coupons or discount codes that you can use only with Volotea.

If it’s their fault, you may have a right to compensation.

Scroll back to learn more about compensation.

5.2 If you are already at the airport

Don’t go through the airport security.

Many don’t realize this, but your ticket isn’t valid anymore. If your flight is cancelled, your ticket isn’t valid anymore. You can’t use the same boarding pass for anything anymore. So, don’t go through the airport security. Go back if you have done it already. And try to get in touch with the representatives of Volotea to learn what’s happening next, what is their offer.

Ask for a refund, if you don’t want to take the new flight.

- 3 hour flight delay

Volotea is an airline registered in the EU.

And that means you are protected by the EU.

If you have to wait at the airport due to last-minute flight cancellation, you have a right to care from your airline. That’s the rules in Europe. Period. What it means is that the airline has to provide you with two free phone calls or e-mails (or internet access) and also a free meal and drink.

Cancellations due to extraordinary circumstances?

This applies to all flight cancellations of Volotea.

All thanks to European flight compensation regulations.

- Long delay (Overnight delay)

In this case, you have a right to free accommodation.

The same applies both to traditional and low cost airlines.

If the wait is over night, you have a right to receive free hotel accommodation and complimentary transfers from Volotea. But you should also know that the airline may decline providing these services, if they deem it unnecessary. For example, if the waiting time is 6 hours, and it would take 2-3 hours for everyone to reach a hotel, and another 2-3 hours to come back to airport, it just doesn’t make any sense for anyone. Take this into account!

5.3 If it is the fault of Volotea

That includes things like technical problems and bad planning.

If that causes a cancellation, it is considered fault of the airline.

And you may also be entitled to EU flight cancellation compensation.

Have you experienced a flight cancellation?

If you have — file a compensation claim.

5.4 Why do flights get cancelled?

Here are some of the top reasons why flights get cancelled.

By Europe and EU we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin, the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.
